These are the terms and conditions for our supply of goods to you through our website. These terms are important and you should read them carefully. They cover the terms of the contract between us, and how we provide goods to you under these terms. We are Top Meadow Farm Limited, a company registered in England and Wales.  Our registered office is at Stone Farm, Alverdiscott Road, Bideford, North Devon EX39 4PN, and our company registration number is 12392559.  Our registered VAT number is 342 3798 86.

If we need to contact you we shall do this by phone, email or at the home address that you have provided to us.

 

  1. THE CONTRACT

When we email you or speak to you on the phone or in the shop to accept your order, a contract will then exist between us. If for any reason we are unable to meet your order or any part of the order, or if we cannot meet the delivery terms you have specified, we shall let you know and not charge you for the order or for this part of your order, as appropriate.

 

  1. OUR AREA

Unfortunately, we are only able to arrange delivery on our standard terms to locations on the mainland of Great Britain, England, Scotland and Wales. If you wish an order to be delivered to a more remote location, such as an offshore island, please contact us to discuss the matter.

 

  1. GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason and at any time. You understand that your information provided to us may be transferred electronically unencrypted, except for your bank account details, credit or debit card details which will always be encrypted when transferred over networks. You may not copy, sell or exploit any part of the material on our website without our express permission.

 

  1. INFORMATION

The material on our website is provided for your general information. We update the information regularly. It is, however, your responsibility to check products, product details or recipes to ensure their accuracy and that they meet your needs, and any health or dietary requirements. Any reliance on the material on our website is at your own risk. We do not accept liability for any loss, damage or injury arising from your use of advice, information, recipes or instructions provided on our website, or accompanying the goods we send to you.

Some of the information on parts of our website may be historical or incomplete. We update the site on a regular basis but it is your responsibility to ensure that any information you utilise is current.

 

  1. OUR MEAT AND OTHER PRODUCTS

The images of the goods on our website are for illustrative purposes only. As natural products there will inevitably be considerable variation in colour, texture and general appearance. All of our meat will be cut and prepared by hand and other products will be artisan, prepared locally by hand, often in small batches. This means that there may be some variation in size, weight and colouring. All weights are approximate. In all cases we shall endeavour to provide additional produce of equal value in the event of one particular cut or product being below the weight stated on the website.

 

  1. OUR SUPPLIERS

We like to inform you of the specially chosen, top-quality local farmers and growers, cooks and artisan producers that supply you. As these are usually small-scale producers able to supply limited amounts to us, we reserve the right to change suppliers at any time, particularly if there are supply and delivery issues or shortages, without us informing you. Most of our suppliers have been subject to site visits by our staff. Where we indicate the organic, “Red Tractor”, RSPCA, or other certification of our suppliers or their award achievement, we have checked this documentation but it is the responsibility of our suppliers to provide updates on changes so that these can be amended on our website.

 

  1. PACKAGING, DELIVERY AND INSPECTING DELIVERIES

We shall make all reasonable efforts to ensure that all products sent to you will be well packaged and should arrive safely. Packaging of our goods may vary from the images shown on our website. Where you have agreed a delivery date with us or with our delivery company, you need to be present to receive the goods or make alternative arrangements for their delivery and safe storage. We cannot be held responsible if you do not adhere to these arrangements. You are responsible for opening and inspecting the goods on arrival and then storing them correctly, for example in a deep-freeze or fridge. If there is a problem with any of the goods you should report this to us as soon as possible and certainly within fourteen days of receipt.  We use third party delivery companies to deliver most of our meat and other produce, so please let us know at the above address if the delivery was unsatisfactory in any way.

 

  1. PRICES

The price of your goods, including VAT or other taxes where appropriate, will be as shown on our website. Our prices will change from time to time but the order price will normally be that indicated on the website at the time of your order. It is your responsibility to ensure that you are using the most current information. In the event of an obvious error in the pricing on the website, we reserve the right to correct this, inform you of the necessary changes and obtain your instructions, giving you a refund of any payment already made, if requested. The costs for delivery are set out on the delivery page of our website.

 

  1. PAYMENT

Unless other arrangements have been agreed, all payments for orders must be made in advance.  We accept payment with all major credit cards, including American Express. Your payment will be taken as soon as your online order is placed. All of our online payments will be processed through Handepay Merchant Services who ensure the highest possible level of security and fraud protection available for all of our customers.  In the unlikely event of our not being able to meet your order within a reasonable timescale, we shall contact you and refund any monies paid. This will be the limit of our liability.

 

  1. DISCOUNTS AND PROMOTIONS

From time to time we shall offer discounts and promotions. Some will be specific to the website and others to the shop. Transfer between these is not permitted. All discount vouchers are subject to additional terms and conditions as specified on the voucher, by the indicated date, subject to product availability and at the final discretion of the management. Only one offer or discount voucher may be used on each order.

 

  1. DOMESTIC AND PRIVATE USE

We only supply goods for domestic and private use. Business customers should contact us individually to discuss their needs and open a business account with us. With our emphasis on quality produce, we may not be able to supply very large orders at short notice. We advise customers wishing to order large volumes of produce to contact us before placing their order online. If you use goods advertised on our website for any business, resale or commercial purpose, we will have no liability for any losses howsoever caused.

 

  1. PERSONAL INFORMATION

The way in which we utilise your personal information is set out in our Privacy Policy.

We use your personal information to supply goods to you, process your payment and, if you agreed to this during the order process, contact you about similar products supplied by us. If you wish to stop receiving information about similar goods please contact us. We value your personal information and will only provide it to third parties if required by law or the law permits us to do so.

These terms and our supply of goods to you are governed by English law.
